Assault & Threats

An assault charge deals with an allegation that someone applied force to another person without their consent. Conduct which constitutes an assault can be as little as a shove or push or much more serious physical contact such as a punch or choking. Assaults that result in bodily harm or that involve the use of a weapon are more serious and carry with them more serious penalties upon conviction.

Threatening charges involve words spoken that amount to a threat to cause a person bodily harm or death. It is the words uttered that make out the offence and there is no requirement for any physical interaction to occur for their to be a criminal charge. The person hearing or receiving the threats need not be the person who is the target or focus of the threats for the offence to be made out.

R. v. L.P. [2024]
Client was charged with an assault that occurred at an event at the Orpheum Theatre in downtown Vancouver.  Mr. Shapray put together a strategy that involved counselling and negotiation with the prosecutor that led to the charges being dropped after a few months and before a trial date was set.

Incident involved dispute between neighbours in Terrace, B.C. that led to assault charges.  Negotiations with prosecutor resulted in an agreement for a "cooling off" period which took place.  Charges DROPPED - No Trial!

R. v. M.G. [2023]
Mr. Shapray's client was charged with Assault Causing Bodily harm in relation to an incident where he punched someone outside a bar and broke the complainant's jaw.  Client did not remember incident (caught on video) due to blackout.  After extensive counselling and rehabilitation we were able to resolve case with a Peace Bond - NO CRIMINAL RECORD!

R. v. I.N. [2023]
Client charged with First Degree Murder and facing life sentence with no possibility of parole for 25 years.  Allegations based on theory of revenge killing.  After over a year of strategic decisions and a number of successful pre-trial applications where Charter violations found, negotiations with Crown led to plea to Manslaughter with a joint submission for 10 year fixed sentence.

Client charged with two counts of assault by live in partner.   Client maintained denial of any assaultive behaviour and case set for trial.  Continued strategic decisions by counsel resulted in the prosecutor DROPPING the charges prior to the commencement of the trial. No Criminal Record and no finding of guilt.  Case closed.

R. v. M.B.  [2022]
Client charged with two counts of assault by ex-wife.  Acrimonious matrimonial proceedings with issue of access and custody of child at the forefront.  Client found NOT GUILTY of both charges after a trial and complainant found not to be credible and also that she weaponized the criminal code in her family law dispute.

Client charged with serious charge of Uttering Threats and Breach of Probation arising out of an intimate partner relationship that had become toxic.  Rehabilitation and counselling program undertaken for a year and Mr. Shapray successfully argued for Probation - Crown had been seeking 5-6 month jail sentence to be served as a CSO.

R. v. M.R.  [2019]
Client charged with Assault and Threats arising out of incident at a Surrey Bar where client had physical altercation with bouncer.  Client remorseful for out of character conduct and submissions made to Judge that situation arose due to interaction between surgery drugs earlier in the day and alcohol consumption at night.  Judge agreed that mitigating features were significant and reviewed positive character reference letters - CONDITIONAL DISCHARGE granted.

Client charged with domestic assault arising in downtown Vancouver and charged in the Downtown Community Court.  Counselling completed and Stay of Proceedings directed by the prosecutor before matter was set for trial.

Domestic assault case involving dispute between a father and his teenage daughters.  Allegations of assault and threats.  Counselling plan and program put into place by Mr. Shapray that resulted in Crown prosecutor re-evaluating the charges after a few months and directing a Stay of Proceedings resulting in NO CRIMINAL RECORD.

Mr. Shapray was retained to assist client charged with an assault against his common law partner of 5 years.  Client had been released on bail with conditions not to have any contact with spouse.  Negotiations with prosecutor led to variation of bail to allow some initial contact and client sent to complete anger management course.  Case resolved with PEACE BOND prior to trial date being set allowing client to return home and NO CRIMINAL RECORD.

Client was charged with making threats against his ex-wife by telephone to a third person.  Nasty matrimonial dispute also taking place concerning custody and access to children.  Client completed an anger management course and case resolved after a few months with a PEACE BOND resulting in NO CRIMINAL RECORD.

Case involved a family dispute between adult brothers that resulted in serious criminal charges involving allegations of choking and assault. Mr. Shapray was retained a managed a program of rehabilitation and counselling that led to a plea to a lesser charge and sentencing hearing that resulted in client receiving a CONDITIONAL DISCHARGE and NO CRIMINAL RECORD.

R. v. E.R. [2019]
Case involved a strange set of circumstances where elderly female client arrested for forcible confinement and threats. Challenge to evidence and allegations in the pre-charge stage of proceedings resulted in case being resolved quickly with a PEACE BOND.

R. v. J.A. [2019]
Client charged with domestic assault and mischief relating to allegations made by ex-wife during ongoing animosity of break-up involving children and property. Bail varied to allow contact between client and his children and challenge to the allegations raised prior to trial date being set resulting in charges being DROPPED.

R. v. A.K. [2019]
Client was charged with a serious of domestic assaults over a number of different dates. Due to additional charges, the client was also charged with multiple counts of breaches his bail conditions not to have contact with his ex-wife. Prosecutor initially seeking jail sentence. Two-pronged approach to case implemented by Mr. Shapray which involved rehabilitation of client through counselling and course work as well as challenge to certain factual allegations which were untrue. Case ultimately resolved prior to trial to plea to two charges and seven charges being dropped – NO JAIL TIME.

Client charged with assault and breach of bail concerning domestic situation. Action plan implemented with client that included completion of anger management counselling which led to negotiations with the crown. Charges DROPPED and client gets NO CRIMINAL RECORD.

Client charged with Assault of a Peace Officer and Utter Threats in relation to a drunken incident during the Vancouver Fireworks festival. Client had no criminal history and matter seemed to be out of character resulting in Mr. Shapray negotiating for client to be referred to Alternative Measures resulting in NO CRIMINAL RECORD and a stay of proceedings for the criminal charges.

Female client charged with Criminal Harassment in relation to a nasty dispute with her ex-husband who also lived on the same street as her. Very acrimonious divorce and multiple allegations of harassing behavior. Client dealing with substance abuse issues as well as stress of charges. Mr. Shapray was retained early in the proceedings and managed a treatment and counseling program and engaged in protracted negotiations with Crown Counsel which ultimately led to case being resolved with a Peace Bond and NO CRIMINAL RECORD.

Client was a young person involved in a tumultuous relationship with a girlfriend during his high school years. Client charged with 2 counts of Assault and a charge of Mischief in relation to his girlfriend. Client was charged with Assault and Threats against his estranged wife. Client suffering from some mental health challenges leading up to the incident and charges. Client was involved in a Road Rage incident resulting in charges of Assault and Utter Threats. Client had forgotten to take certain medication that morning and was dealing with many stressful issues in his life. Female client charged with assault against her husband arising in a domestic situation. After a number of court appearances, bail variations to allow staggered contact with her husband, and counseling being completed by the client, the Crown directed a STAY OF PROCEEDINGS which allowed the marriage to be rehabilitated and resulted in NO CRIMINAL RECORD.

Client charged with Causing Damage to Property in a domestic situation. Client was involved in a domestic relationship but was suffering from some mental health and drug addictions issues. Client was charged with a number of assaults against his children who were embroiled in a nasty divorce and custody dispute. Mr. Shapray was retained at a late stage in the proceedings and was able to work out a resolution that resulted in two of the charges being dropped and a plea to a single count. A contested sentencing hearing was held and the prosecutor sought to have a Criminal Record imposed on the accused. After hearing submissions, the Judge agreed with Mr. Shapray and imposed a Conditional Discharge resulting in NO CRIMINAL RECORD.

Client charged with assault and threats in relation to an incident with his girlfriend. Client had some substance abuse and anger issues. Female client charged with 2 counts of assault with a weapon involving 2 children living in her home. Mr. Shapray challenged the evidence of one of the counts and managed a counselling and rehabilitation plan for the client which resulted in the client being granted an ABSOLUTE DISCHARGE – NO CRIMINAL RECORD.

Client charged with a domestic assault regarding an incident with his wife. Mr. Shapray managed a treatment and counselling program with the client which led the his bail conditions being varied to gradually allow contact with his wife. Case ultimately resolved with a PEACE BOND and client and his wife were allowed to continue their relationship.
